(Grand Haven, MI - WHTC News) - Authorities say that Darrin Arens was hampering rather than helping, while the 43-year-old Robinson Township man disagrees.

That was the crux of the argument that continued during a preliminary hearing in Grand Haven District Court on Tuesday, as Arens was bound over for trial on resisting and obstructing charges in the wake of his brother’s death. Jeffrey Arens either fell or jumped off of a pontoon boat in the Grand River on July 24th and never resurfaced alive. Darrin Arens allegedly refused to dock his boat upon police command during the search for his brother’s body.

Prosecutors reportedly offered a plea deal to Darrin Arens that would have expunged his record upon successful completion, but he refused. He could face two years in jail if convicted, and remains free on bond pending a requested jury trial.

The pilot of the pontoon boat when Jeffrey Arens died faces drunken boating charges.
